Criminal History Searches
Please read the description of this search thoroughly! There is NO REFUND for this search irrespective of the results, except as noted in the overview of the search below.
This search is designed to provide a comprehensive, and potentially nationwide, Criminal History Search of the individual you are searching. However, there are several steps to accomplish this, including additional work by the client after receiving the results of this search.
Please note that there is no such thing as a nationwide database search that covers everything. Even NCIC, which is a cooperative police system, is incomplete. This search does not have access to NCIC. NCIC is not available to the public, or to other private companies. Visit the Master Search page for a search that only provides criminal conviction records found.
Criminal Records exist at various levels:
Local & State Police Departments - Arrest records for their jurisdiction.
Local, County, State & Federal Courts - Criminal case files for their jurisdiction.
State & Federal Corrections Departments - Prison time served, Probation & Parole information.
Statewide Criminal Records Bureaus - Criminal Conviction History
All of these different agencies maintain their own records department, with their own computer system. Some are connected statewide. None are known to be connected across state lines. All have different rules of access and information available.
This search does several things.
First, it takes the information that you provide and conducts a search to identify addresses found to have been used by the individual. This is important, as it determines which jurisdictions need to be searched. Criminal records do not follow people when they move, they are kept where the crime occurred. This will also provide the names of the Counties where the individual resided. This is important for step four, as many courts are within county jurisdictions.
Second, a data search is conducted to locate arrests or convictions found to exist for that individual. Please note the coverage area noted below. The individual is researched through ALL of the databases noted for the jurisdictions noted below.
Third, we will provide information to aid you, the customer, in contacting the various departments noted above to obtain additional, detailed information.
For example, a criminal record may be found in the database that indicates John Doe was arrested and plead guilty of Breach of Peace. This charge could be for almost anything from having a stereo too loud, to assaulting a police officer, or worse. Charges could simply have been part of a lesser plea, not specifically related to what the individual may have actually done.
This is why it is necessary to then contact the individual police departments, courts or correctional facilities, to fully learn what the individual's actions were.
Additional information provided may be addresses, telephone numbers, or government web sites depending on the jurisdictions found to be related to that individual case. Keep in mind that every jurisdiction and department has different rules regarding the availability of records, how many years they keep records, etc. For example, some states will retain criminal records indefinitely, while Massachusetts restricts criminal history disclosure to 2 years after an individual has served time, parole or probation. Laws in different jurisdictions vary widely and are constantly changing. Do not hesitate to ask each department what time period their records cover.
Fourth, and lastly, you, the customer, will have to contact these departments on a case by case basis.
However, the database search results may provide you with sufficient information that you will not need to pursue the matter further. The results of our search will give you a step by step instruction of how to do so, including a sample letter if a written request has to be submitted. Even if there were no criminal records found in our database search, you should still contact the departments as directed. For example, most publicly provided database records provide information on convictions only. By contacting the individual police departments, you may find arrests that never led to a conviction, or were nolled, and/or incidents that the individual was involved in that never led to an arrest. This type of information is only available from local police departments and is never part of a database search.
As noted above there is No Refund for this search. However, if we are unable to obtain sufficient information to develop an address history, you will receive a $100 credit. This is provided because if an address history is unavailable, there is no way to know if the proper jurisdictions were searched, nor could we provide any information as noted in Step Three. This search will Not provide any criminal history on minors, as it would not exist in any publicly available database. If you suspect that the individual is a minor, do not place the search, as there is No Refund.
We developed this search, and the steps noted above, to provide the most comprehensive nationwide criminal history search available, and still be cost effective for our customers.
